Standard Usage |

The End-User may install (1) copy, of each of the product(s) which they purchased to be used by their company. The license covers (1) site or domain, and all users for that site (no Renting or Application Service Providing). Any users which log into the software must be affiliated with the End-User or Business Entity. |

Software Products Pertaining To This Agreement |
| |
Any software, licensed or authored by Surf Highway Software is covered under this End-User License Agreement. All software authored by Surf Highway Software is NOT SOLD, but rather licensed to the End-User (purchasing person or business entity). This agreement is a full version of the binding End-User License Agreement which is present on the Surf Highway Software web store “check-out” page. Purchasing the software binds the End-User to all terms of use described in this document. |

Software Components and Copyright Laws |

The software licensed by Surf Highway Software is comprised of: database scripts, database import files, ASP files, end-user documentation, images, and other necessary files. All of these components are protected by both federal (U.S.) and international copyright laws. The software which you purchased a license of is owned by Surf Highway Software and the license purchase by the End-User does not constitute a sale of any part of the source code or related components. |

Customization for End-User |

Surf Highway Software grants the End-User the right to change the source code or other software components to meet the needs of their company. Changing the software does not constitute a new product and none of the software (changed or unchanged) may be sold or redistributed without authorization in writing from Surf Highway Software. |

Customization for a Client |

If the End-User or Business Entity has a client which needs a customized version of any Surf Highway Software product, then the customer must purchase a license separately from the End-User. The customer’s licensed copy may then be modified to fit the needs of said customer by the End-User. Changing the software does not constitute a new product and none of the software (changed or unchanged) may be sold or redistributed without authorization in writing from Surf Highway Software. |

Protection of Confidential Information |

The End-User or Business Entity understands and acknowledges that the software and its components are confidential and proprietary information owned by Surf Highway Software … and will protect the software from improper disclosure and hold such information in confidence. |

Use of Software |

If you do not agree completely to all of the terms described in this document, then you may not use this software. However, not agreeing does not constitute a refund for purchase of any software from Surf Highway Software. All sales are final due to the nature of source code being revealed upon “receiving” the package via e-mail or downloading as a link over the internet. |

Liability |

Surf Highway Software is not liable in any way and in no event for the use or misuse of software purchased from Surf Highway Software (including all products authored by Surf Highway Software). Any loss/gain of business profits, business interruption, loss of business information, or any other pecuniary loss arising out of the use or inability to use the purchased software is solely the responsibility and prerogative of the End-User or Business Entity. |

Warranty |

Surf Highway Software guarantees that for a period of ninety (90) days starting at the product purchase date, the software product(s) will operate and function in accordance to the sales documentation and text contained on the surfhighway.com web site and in the user documentation. If any part of the software causes it to not function according to the user documentation and surfhighway.com web site, then Surf Highway Software will correct it and replace the purchased software at no cost. This warranty will be void if the software product(s) fail due to lack of knowledge, use on a platform not specified in the system requirements, abuse, misuse, or accidents. |
